1. Definitions
“Pest Control Works”, “we”, “us”, or “our” refers to Pest Control Works (ACN: 647241165).
“Client”, “customer”, “site operator”, or “you” refers to the individual, company, or organisation receiving services.
“Services” refers to pest inspections, treatments, monitoring, reporting, or other pest management activities carried out by Pest Control Works.
2. Scope of Services
Services are performed in accordance with relevant Australian Standards, industry codes of practice, and applicable state and federal regulations. Where termite management is involved, work may follow the requirements of AS 3660.
Treatment methods, pesticides, monitoring systems, and pest management strategies are determined by our licensed technicians based on inspection findings, pest biology, and site conditions.
Pest management services aim to reduce pest populations and minimise infestation risks. Due to environmental conditions, pest movement, and biological factors, complete elimination of pests cannot be guaranteed.
3. Integrated Pest Management
Services form part of an Integrated Pest Management (IPM) approach.
Effective pest control requires cooperation between the service provider and the client. The client is responsible for maintaining appropriate standards of sanitation, waste management, stock rotation, food storage, and building maintenance.
Where pest activity is influenced by operational practices, hygiene conditions, structural defects, or environmental factors beyond our control, pest presence may continue despite treatment.
4. Routine Service Programs
Commercial pest management services may be delivered on a scheduled basis such as monthly, bi-monthly, or quarterly.
Maintaining the agreed service schedule is essential for effective pest management. If services are postponed, cancelled, or access is unavailable, pest control outcomes may be affected.
Additional visits may be required to restore control if service intervals are extended.
5. Pest Activity
Pest activity may occasionally occur between scheduled services due to seasonal movement, migration from surrounding areas, or environmental conditions.
Isolated sightings do not necessarily indicate failure of the pest management program.
Where pest activity exceeds normal levels, additional treatment or inspection visits may be recommended and may incur additional charges unless included in the service agreement.
6. Client Responsibilities
- kitchens and food preparation areas
- storage areas and warehouses
- plant rooms and service spaces
- roof voids or ceiling cavities
- external building perimeters
- waste and refuse areas
7. Monitoring Equipment
Rodent stations, insect monitors, traps, and other pest monitoring devices installed as part of the pest management program remain the property of Pest Control Works unless otherwise agreed in writing.
Devices must not be opened, moved, relocated, tampered with, or removed by the client, staff, contractors, or third parties.
Tampering with monitoring equipment may affect pest management outcomes and may void applicable warranties.
8. Rodent Baiting Safety
Where rodent bait stations are installed, they are positioned and secured in accordance with pest management regulations and industry practices.
Clients must ensure bait stations remain accessible for servicing and are not interfered with.
Pest Control Works is not responsible for incidents resulting from bait stations being moved, damaged, opened, or tampered with by unauthorised persons.
9. Structural and Environmental Factors
Pest Control Works is not responsible for pest entry or harbourage caused by structural defects, damaged doors or seals, drainage faults, landscaping conditions, neighbouring infestations, or other environmental factors beyond our control.
Recommendations regarding proofing, sanitation, waste management, or building maintenance may be provided where appropriate.
Implementation of these recommendations remains the responsibility of the client.
10. Service Reports and Documentation
Service reports may be provided following each visit outlining work performed, pest activity observed, and recommendations where relevant.
Where required for regulatory, hygiene, or audit purposes, pest management records may be maintained to support compliance documentation.
The client is responsible for retaining documentation required by regulatory authorities or audit bodies.
11. Food Safety and Compliance
Pest control services may assist businesses in meeting pest management requirements under food safety regulations or industry audit programs.
However, pest control services alone do not guarantee compliance with any inspection, audit, or regulatory requirement.
Compliance outcomes depend on factors including sanitation standards, building maintenance, food handling practices, and waste management.
12. Customer Sightings and Business Impact
Pest Control Works is not responsible for reputational, financial, or operational losses resulting from pest sightings by customers, staff, visitors, or regulatory authorities.
Pest control services reduce pest risks but cannot prevent all pest sightings due to factors such as pest migration, structural conditions, or environmental influences.
13. Health, Safety and Environmental Compliance
All products used are approved for use in Australia and applied according to label instructions and regulatory requirements.
Safety Data Sheets (SDS) are available upon request.
Clients must ensure that staff, occupants, customers, and animals remain away from treated areas for the recommended period following service.
14. Chemical Sensitivities
The client must notify Pest Control Works prior to treatment of any known chemical sensitivities, allergies, or health concerns relating to occupants of the premises.
Pest Control Works is not responsible for reactions arising from undisclosed sensitivities.
15. Photography and Documentation
Technicians may take photographs during inspections or services for documentation, reporting, or record-keeping purposes.
Photographs will be used only for operational documentation or pest management reporting.
16. Payment Terms
Unless otherwise agreed in writing, payment is due upon completion of the service.
Commercial clients may receive invoices in accordance with the agreed service arrangement.
Late payments may incur administrative fees, interest, or recovery costs where permitted by law.
17. Additional Services
Services requested outside the agreed scope of work or routine service schedule may incur additional charges.
This may include emergency call-outs, infestation treatments, or services outside the agreed pest management program.
18. Cancellations and Access Failure
Cancellations made within 48 hours of a scheduled service may incur a fee of $100 or 30% of the service fee, whichever is greater.
Where technicians attend site but cannot access the premises or treatment areas, a call-out fee may apply.
Appointments may be rescheduled where weather conditions, safety concerns, or operational restrictions prevent safe completion of services.
19. Warranty and Limitations
Any warranty or service guarantee will be stated in writing where applicable.
Where no written warranty is provided, no warranty applies.
Warranties may become void where:
- recommended sanitation or proofing measures are not implemented
- building alterations affect treatment areas
- monitoring equipment is tampered with
pest activity originates from neighbouring properties or environmental conditions beyond our control
20. Service Agreements and Termination
Where services are provided under an ongoing service agreement, either party may terminate the agreement by providing written notice, typically 30 days unless otherwise stated in the service contract.
Services performed prior to termination remain payable in full.
21. Liability
To the maximum extent permitted by law, the liability of Pest Control Works is limited to either re-performing the service or refunding the service fee in accordance with Australian Consumer Law.
Pest Control Works is not responsible for:
- pre-existing pest infestations or damage
- structural damage caused by pests prior to treatment
- pest activity originating from neighbouring properties or surrounding environments
indirect or consequential losses arising from pest activity
22. Privacy
Personal information collected during the provision of services is handled in accordance with the Privacy Act 1988 (Cth).
Information will not be shared with third parties except where required by law or necessary for service delivery.
23. Force Majeure
Pest Control Works will not be liable for delays or failure to perform services due to circumstances beyond reasonable control, including severe weather, natural events, access restrictions, or government directives.
24. Governing Law
These Terms and Conditions are governed by the laws of Victoria and the Commonwealth of Australia.
Any disputes arising from services provided will be subject to the jurisdiction of the courts of Victoria.
Acceptance
Acceptance of a quotation, service agreement, booking, or allowing services to proceed constitutes acknowledgement and acceptance of these Terms and Conditions.
